Family Wealth Alliance Event - Terms and Conditions
Please note, by submitting registration details to be an attendee, sponsor, exhibitor, or a speaker (“You”, “Me”, or “I”) at a Family Wealth Alliance, Inc. (“FWA”) event, whether in person or online, you agree to the below terms and conditions (the “Agreement”). You should retain a copy of this Agreement for your records.
Please read this Agreement carefully. By participating in the FWA event, you agree that you freely and knowingly assume the risk and waive rights concerning liability as described below.
If you do not accept this Agreement, you may not attend or serve as a speaker at the event.
Release; Recordings. I do hereby irrevocably grant to FWA and its parent and their respective affiliates, officers, directors, employees, vendors, suppliers, agents and licensees, the absolute right and permission to record my presentation, likeness, and/or voice with still photography, film, videotape or digital media, to edit such still photographs, film, videotape or digital media (“Recordings”) at the discretion of FWA, to incorporate the same into social media, marketing materials, photo exhibits, motion picture films, video or digital media and internet presentations, to use or authorize the use of Recordings, or any portion thereof, in any manner at any time or times throughout the world in perpetuity, to copyright, use, reuse, publish, republish, exhibit, display, print and reprint in advertising, publicity or promotional material, magazines, books or any other digital media including the internet, to use or authorize the use of the Recordings, including the right to use my name, likeness, presentation, and biographical and other information concerning me in connection with the exhibition, advertising, promotion or any other use of the Recordings in all media, now known or later developed, without compensation to you.
FWA owns the copyright in the Recordings. To the extent that I have any rights in the Recordings, I hereby assign all rights, title, and interest, including all intellectual property rights, in the Recordings to FWA.
I hereby waive any right to inspect or approve the Recordings that may be used in conjunction therewith and further waive any claim that I may have with respect to the eventual use, if any, to which it may be applied. Such Recordings may be used at FWA’s sole discretion, with or without my name or attribution.
I hereby release, discharge and agree to save harmless FWA from any and all claims, damages, liabilities, costs, and expenses that I now have or may hereafter have by reason of any use of the Recordings.
I expressly release FWA and its parent and their respective affiliates, officers, directors, employees, vendors, suppliers, agents, licensees and assigns from and against any and all claims which I have or may have for invasion of privacy, defamation, violation of any right to publicity, or any other cause of action arising out of the Recordings.
I have read this release, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that by registering for this event, I am agreeing to the aforementioned release freely and voluntarily and intend by my registration to be a complete and unconditional release of all liability to the greatest extent allowed by law.
Speakers. You may be an attendee that is participating in the event as a speaker. In the event I am unable to participate in the event, I will immediately notify FWA. I understand that any written materials, PowerPoint or similar presentations, and other content I may provide or use in connection with my presentation may, in FWA’s discretion, be recorded as part of the Recordings and distributed, copied, and otherwise used as described in the release, above. The presentation materials are my own original material or material for which I have full authority to grant the rights set forth in this Agreement.
No Recording of Event by Attendees. No attendee may record the event through any means, including screen capture of online events, without FWA’s prior written authorization.
Use of Registration Information. By submitting registration details or agreeing to be a speaker at the event, I agree to allow FWA and companies associated with the event to contact me regarding my attendance and/or services. All attendees will be listed in the attendee directory, virtually and/or print, and access to this directory will be restricted to event attendees. This directory and data may also be uploaded into an event app allowing attendees to connect. Attendees will have the option to modify their privacy settings on the app during the event. The contact details of registered attendees will also be placed on the attendee list which will be passed to Alliance Partner firms, sponsors, and/or exhibitors. Attendees who do not wish to be included on this list should advise FWA in writing at info@fwalliance.com by the Monday following the end of the event.
Publicity Material and Other Content. FWA reserves the sole right to use any photographs, recordings, video, electronic images or publicity material received by or obtained by FWA in the course of the event, for whatever use deemed proper by FWA. FWA has the exclusive right to include photographic, video and other visual portrayals of attendees, sponsors, exhibitors and their exhibits including its contents and as part of the Recordings, in any pictorial medium of any nature whatsoever, including social media, for the purpose of trade, advertising, sales, publicity and otherwise, without compensation to the attendee, speaker, sponsor or exhibitor, and all rights, title, and interest (including all worldwide copyrights therein) will be FWA’s sole property, free of any claims of attendee, exhibitor or sponsor or any persons deriving any rights or interest from the attendee, exhibitor or sponsor.
Admittance. In its sole discretion and without refund, FWA reserves the right to refuse admittance to or expel from the event anyone that it determines is behaving in a manner that could be disruptive to the event or any other attendee.
Promotions and Contests. Promotions or contests may be conducted at certain events. Those promotions and contests are sponsored by third parties, not FWA. The third parties are solely responsible for all aspects of the promotion or contest, including ensuring compliance with all applicable federal, state, and local laws, rules, and regulations (as well as the terms of use of any websites or services on which the promotion or contest may be run or hosted), and preparing appropriate official rules for the promotion or contest. In particular, FWA has no responsibility for and is in no way involved in the creation, execution, administration, sponsorship, or fulfillment of the promotion or contest. You expressly waive all claims or damages you may have, whether now known or later discovered, against FWA in any way arising out of the promotion or contest.
Disclaimer. Neither FWA nor its parent or their respective affiliates, officers, directors, employees, vendors, suppliers, agents, licensees, members, representatives, or assigns shall be liable for any loss, liability, damage or expense suffered or incurred by me arising out of the event, the Recordings, or this Agreement. FWA may at any time, with or without giving notice, in its absolute discretion and without giving any reason, change, cancel, or postpone the event, change its venue or any of the other published particulars, or withdraw any invitation to attend. In any case, neither FWA nor its parent or their respective affiliates, officers, directors, employees, vendors, suppliers, agents, licensees, members, representatives, or assigns shall be liable for any loss, liability, damage or expense suffered or incurred by any person relating to the event or any matters addressed in this Agreement. Fees paid to attend the event are non-refundable, except in FWA’s sole discretion.
As part of the event, FWA may make available various live or recorded presentations, including those by third party speakers. In addition, FWA may make content created by third parties available. The comments and opinions of the third-party speakers and any third-party content may not reflect the opinions of FWA. Those comments and content solely represent the opinions of the third-party authors.
THE EVENT AND INFORMATION PROVIDED IN CONNECTION WITH THE EVENT ARE NOT INTENDED TO RENDER FINANCIAL OR INVESTMENT ADVICE. YOU ARE SOLELY RESPONSIBLE FOR ANY VERIFYING THE APPROPRIATNES OF THE INFORMATION FOR YOUR INTENDED USES AND ANY DECISIONS MADE ON BASED ON THE INFORMATION.
Assumption of Risk. Your participation in the event may involve risk of injury or loss of property which may result not only from your own actions, inactions or negligence, but also the actions, inactions or negligence of others, and the conditions, facilities, and equipment present at the event, including the presence of communicable diseases and viruses (e.g., COVID) that may be spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and, even, possibly through the air; and there may be other risks not known or reasonably foreseeable. You participate in the event at your sole risk. You are responsible for your own health and safety and the security of any personal items and other materials you bring to the event.
Force Majeure. FWA shall not be held responsible for any delay or failure in performance of its obligations hereunder to the extent such delay or failure is caused by fire, flood, strike, civil, governmental or military authority, acts of God, acts of terrorism, acts of war, epidemics, internet unavailability or slow down, the availability of the venue or other similar causes beyond its reasonable control and without the fault or negligence of FWA or its subcontractors. For one or more of such reasons, FWA may postpone, reschedule or cancel the event without liability on the part of FWA. If the event cannot be held or is postponed pursuant to this section, FWA shall not be liable to attendee for any damages, costs, or losses incurred, such as transportation costs, accommodations costs, or financial losses. FWA will review refund and/or fee transfer requests, submitted in writing, for approval on a situational basis.
FWA Transfer Policy. Another individual may participate in my place subject to FWA’s prior written consent and the new registrant must agree to this Agreement by default of transfer in writing.
Choice of Law and Venue. The interpretation and enforcement of this Agreement will be governed by the law of the State of Texas. The parties agree that all actions or proceedings arising in connection with this Attendee Release Agreement will be tried and litigated exclusively in the state or federal courts (if permitted by law and a party elects to file an action in federal court) located in Dallas, Denton, or Tarrant Counties, Texas. This choice of venue is intended by the parties to be mandatory and not permissive in nature, and to preclude the possibility of litigation between the parties with respect to, or arising out of, this Agreement in any jurisdiction other than that specified in this paragraph. Each party waives any right it may have to assert the doctrine of forum non conveniens or similar doctrine or theory or to object to venue with respect to any proceeding brought in accordance with this paragraph.
Entire Agreement. This Agreement supersedes all prior agreements pertaining to its subject matter and can only be amended by written agreement signed by an officer of FWA.
